Fallen subprime lending titan Aurora Loan Services LLC will pay $5.3 million to resolve a class action alleging it used deceptive mortgage forbearance agreements to extract unearned payments from distressed California borrowers, according to settlement papers filed Thursday.

A California federal judge on Thursday refused to throw out a putative class action accusing lender Aurora Loan Services LLC of using illegal mortgage agreements to extract unearned payments from the plaintiffs, finding that the claims aren't preempted by federal law.
