The Second Circuit declined to revive a suit in which the president of a boutique merchant banking firm sought to challenge an Internal Revenue Service summons on his wife's assets, which was issued in connection with a roughly $25 million unpaid tax penalty, saying Friday that a lower court lacked jurisdiction.
