An Arizona couple have asked the Ninth Circuit to reverse a decision by the U.S. Tax Court for a $6.4 million levy against them, saying the lower court reached the wrong result because there is a genuine issue of material fact as to whether the Internal Revenue Service destroyed the taxpayers' original tax records.
