Weekly Internal Revenue Bulletin

The Internal Revenue Service on Friday released its weekly Internal Revenue Bulletin, indicating its partial acquiescence to a 2019 U.S. Tax Court decision and highlighting a notice allowing high-deductible health plans to cover novel coronavirus testing and treatment.

The IRS highlighted in the bulletin dated Monday its intention to follow just the result of a decision from the U.S. Tax Court in May that found the agency wrongly relied on a regulatory notice in denying a couple earned income tax credits. While the agency will follow the holding, it disagrees with the court's reasons for siding with the couple, according to the bulletin.

The bulletin also included a notice from the IRS indicating that high-deductible health care plans can provide coverage for testing and treatment of the new coronavirus before plan members meet the minimum deductible. This coverage wouldn't jeopardize plan's status under Internal Revenue Code Section 223(c)(2)(A) , according to the notice.

The bulletin also included a notice saying that all three segment rates used to calculate pension plan funding decreased slightly in March.
