A Fifth Circuit panel halved a government kickback judgment against KBR Inc. Friday in a published opinion concluding only one of two employees had the authority to act on the company's behalf when taking alleged bribes from a U.S. Army subcontractor.

The federal government urged the Fifth Circuit on Friday to leave intact a lower court's finding that KBR Inc. was liable under the Anti-Kickback Act for favors two employees received from a subcontractor, saying there was no dispute the employees acted on behalf of the company.

KBR Inc. urged the Fifth Circuit Wednesday to overturn a "fundamentally flawed" $108,000 civil penalty against it, arguing the Texas federal court judge conflated cheap, relationship-building entertainment, by a military logistics project subcontractor to two low-ranking employees, with influence-peddling bribes.
