There were too few waitstaff allegedly stiffed on tips at a Philadelphia restaurant for a federal court to fully certify an ex-waiter's proposed class of plaintiffs, who can still opt into the minimum-wage case by joinder, a Pennsylvania federal judge ruled Friday.

A Pennsylvania federal judge has handed a former restaurant server a partial quick win in his suit claiming the business failed to pay him minimum wage under state and federal law, ruling that the eatery incorrectly claimed a tip credit under those provisions but that it's unclear whether it willfully broke the law.
