The Ninth Circuit on Wednesday found that a lower court correctly decertified the class in litigation against McKesson brought under the Telephone Consumer Protection Act over alleged junk faxes, agreeing that the consumers hadn't shown they could distinguish ads delivered via a physical fax machine versus an online fax service.
