    ERISA Admin Must Reimburse Insurer For Overpaid Damages

    An ERISA benefits plan administrator must forfeit about $280,000 that its insurer mistakenly overpaid for coverage of a $5.7 million arbitration award, a California federal judge ruled, saying the administrator would be unjustly enriched if it were allowed to receive damages in excess of its policy limit.
