9th Circ. Told Ambiguity Changes Policy's Trigger For Notice
The Ninth Circuit was told Tuesday during oral arguments by the estate of a man who died after taking a weightlifting supplement containing an illegal substance that a coverage dispute against underwriters of Lloyd's of London should be reinstated, arguing that ambiguities in the notice requirements changed it from a "claims-made" to an occurrence-based policy.
