Coast Guard Off Hook For Cleanup Of Tug Oil Spill

Law360, New York (June 29, 2009, 12:00 AM EDT) -- A federal judge has ruled in favor of the U.S. Coast Guard National Pollution Funds Center in a lawsuit brought by a pollution liability insurance underwriter seeking reimbursement of cleanup costs for an oil spill off the Massachusetts coast.

Judge Rya W. Zobel of the U.S. District Court for the District of Massachusetts on Monday granted summary judgment to NPFC, ruling that the agency's decision to deny Water Quality Insurance Syndicate's claim for partial cleanup costs of the spill was “rationally connected to the facts.”...
