Motorola Loses Bid To Dismiss Apple, Next IP Suit

Law360, New York (March 9, 2011, 8:36 PM EST) -- A federal judge in Wisconsin on Tuesday denied Motorola Inc.'s bid to dismiss 12 claims of patent infringement brought by Apple Inc. and Next Software Inc. in a battle over smartphone technology.

Judge Barbara B. Crabb of the U.S. District Court for the District of Wisconsin denied without prejudice Motorola’s motion to dismiss the complaint or sever and transfer claims to the U.S. Court for the District of Delaware, where a separate suit over the same claims is pending.
