EEOC Settles Early Retirement Suit Against Minn. Agency

Law360, New York (November 3, 2011, 7:16 PM EDT) -- The U.S. Equal Employment Opportunity Commission on Thursday settled its suit claiming a Minnesota agency’s early retirement plan wrongly denied benefits to older employees, after the Eight Circuit ruled in another case that reduced benefits for older employees violate federal labor laws.

U.S. District Judge Susan Richard Nelson signed off on a consent decree ending the EEOC’s suit alleging the Minnesota Department of Public Safety’s early retirement incentives unfairly favored younger retirees, in violation of the Age Discrimination in Employment Act.
