European Patent Office Revokes Applera Online-PCR Patent

Law360, New York (February 1, 2005, 12:00 AM EST) -- The European Patent Office has revoked a commercially important online-PCR patent held by gene research equipment maker Applera Corporation following an opposition by German rival Eppendorf AG.

In December, the EPO's Opposition Division revoked patent EP 0872 562 B1, "Instrument for monitoring nucleic acid amplification reactions," for lack of novelty, according to Jones Day, which represented Eppendorf.
