EEOC's Temp Agency Bias Suit Wasn't Frivolous, 6th Circ. Told

Law360, New York (April 17, 2012, 9:50 PM EDT) -- The U.S. Equal Employment Opportunity Commission on Friday urged the Sixth Circuit to toss an award of $750,000 in fees and costs as part of its botched case against temporary employment agency Peoplemark Inc., arguing it did not lodge a frivolous suit.

The EEOC said in a brief that it had a reasonable basis for bringing its Title VII disparate impact suit challenging Peoplemark's alleged companywide policy, which barred those with felony convictions as potential employees.
