DuPont's Supply Pacts Stifled Market, Kolon Tells 4th Circ.

Law360, New York (October 24, 2012, 7:15 PM EDT) -- Kolon Industries Inc. pushed the Fourth Circuit on Tuesday to agree with its claims that DuPont Co. established a monopoly on the market for a body armor fiber by setting supply agreements that restricted competition, and to overturn a lower court's ruling in favor of DuPont.

DuPont's significant market share, coupled with its ability to price-discriminate, shows that the company held a monopoly on the market for para-aramid fibers — evidence that a Virginia federal court overlooked, according to the brief Kolon filed Tuesday.
