US Settles $10M Nu-West Suit Over Phosphate Mine Cleanup

Law360, New York (March 6, 2013, 5:17 PM EST) -- An Idaho judge on Wednesday approved a deal whereby the U.S. will pay $2 million to resolve a $10 million Nu-West Industries Inc. suit accusing it of incompetence in its oversight of the mining company's cleanup efforts at four historic phosphate mines.

Under the deal, the U.S. will assume a 33 percent allocation of past and future response costs incurred in response to the release of hazardous material at the sites, with Nu-West shouldering the remainder of the burden. The parties will compensate each other according...
