A Florida federal judge on Wednesday denied Capital One Bank's bid to block Hawaii and Mississippi from pursuing consumer fraud lawsuits against it, saying those states' attorneys general couldn't be bound by a $250 million class action settlement to which they were not parties.

Capital One on Friday urged a judge to bar attorneys general from Hawaii and Mississippi from pursuing consumer fraud lawsuits over its Payment Protection product, saying its 2010 class action settlement of $250 million bars future litigation over the credit card program.

A judge has granted conditional class certification to credit card holders alleging Capital One Bank’s Protected Payment product, an extra service that promises to pay balances on credit cards in certain situations when consumers are unable to, is essentially worthless because bureaucratic hurdles make it nearly impossible to actually receive the program’s benefits.
