2nd Circ. Weighs Sanction Doled To Bombastic Fosamax Atty
The Second Circuit asked Friday about the propriety of a $2,500 sanction slapped on Gary J. Douglas, a lawyer for Fosamax plaintiff Shirley Boles, for "insidiously" injecting the notion of punitive damages into the bellwether trial when none were on the table and for a rash of "vaudeville" behavior.

Merck Strikes Damages Deal In Fosamax Bellwether Case
Merck & Co. Inc. has reached a confidential damages agreement in New York federal court with the estate of a Florida woman whose $8 million jury verdict in jawbone-death litigation over osteoporosis drug Fosamax was later overturned, an attorney for the plaintiff said Tuesday.

A judge has denied pharmaceutical giant Merck & Co.'s request to toss out the testimony of a doctor who says osteoporosis drug Fosamax caused the plaintiff of a bellwether product liability trial to develop a degenerative bone disease.
