Snack company Diamond Foods Inc. has agreed to pay $2.6 million to settle a false advertising class action over claims that its walnuts could improve heart health, according to the plaintiff's bid Friday to approve the deal.

A California federal judge granted class certification Tuesday in a suit alleging Diamond Foods Inc. misleadingly promotes its walnuts as capable of promoting heart health, rejecting the packaged food company's contention that the named plaintiff lacked standing.

The plaintiff in a putative class action in California accusing Diamond Foods Inc. of falsely promoting its walnuts as heart-healthy said Tuesday that the company is hiding behind attorney-client privilege in refusing to turn over certain documents and witnesses.
