Government Employees Insurance Co. on Monday escaped a collective action accusing it of cheating telephone claims representatives out of pay when a New York federal judge deemed the workers exempt from an overtime provision in the Fair Labor Standards Act.

A New York federal judge on Tuesday upheld a magistrate's decision to certify a collective action brought by current and former claims examiners for Government Employees Insurance Co., who allege the insurer refused to pay them overtime as a matter of policy.
