Covidien Inc. on Wednesday escaped a putative class action from pharmaceutical sales representatives who allege the company misclassified them as exempt from overtime laws, following the U.S. Supreme Court's decision in Michael Shane Christopher et al. v. Smithkline Beecham Corp.

A Tennessee federal judge denied Covidien PLC's bid to shake an overtime pay collective action Friday, saying there was not yet enough information to determine whether the company should be considered a joint employer of the plaintiffs with Tyco Healthcare Group.

Pharmaceutical sales representatives who allege Covidien Inc. misclassified them as exempt from overtime laws and failed to pay them properly should be able to bring their claims as a collective action, a magistrate judge in Tennessee said Monday.
