A Texas federal judge on Friday booted Axcess International Inc.'s patent malpractice case against Baker Botts LLP, saying in light of the U.S. Supreme Court's decision in Gunn v. Minton, the dispute belongs in state court.

Axcess International Inc. asked a Texas federal judge Thursday to reject arguments by Baker Botts LLP that Axcess' suit — which accuses the law firm of sharing Axcess patent applications with a competitor — is time barred, saying the firm concealed its relationship with the rival, resetting the statute of limitations.
