An order in a patent dispute barring Lupin Ltd. from selling its generic version of the diabetes drug Fortamet once again will be scrutinized by the Federal Circuit on Wednesday, two months after the appeals court lifted the same preliminary injunction.

A federal judge on Tuesday ordered Lupin Ltd. to stop selling its generic version of Type 2 diabetes treatment Fortamet, the subject of a patent infringement suit, but denied patent holder Shionogi Pharma Inc.'s request to recall the generics already on the market.
