Former Rutgers quarterback Ryan Hart said in New Jersey federal court filings Monday he neither knew of nor agreed to the $40 million settlement of an antitrust class action, in which Hart is lead plaintiff, over unauthorized use of athletes' names and likenesses in Electronic Arts video games.

The Third Circuit ruled Tuesday that the First Amendment does not shield video game publisher Electronic Arts Inc. from a former quarterback's right of publicity suit, adding to a growing consensus that the use of a person's likeness is protected speech only if it is transformed into an original expression.

A New Jersey federal judge on Friday threw out former Rutgers University quarterback Ryan Hart's class action claiming Electronic Arts Inc. had misappropriated college football players' likenesses by featuring virtual versions of them in the video game "NCAA Football."
