A federal judge has shot down Abbott Laboratories' bid for an interlocutory appeal of her decision not to dismiss claims from four suits accusing the pharmaceutical company of illegally jacking up the price for its HIV drug Norvir.

Four suits accusing Abbot Laboratories of illegally jacking up the price for its HIV drug Norvir will remain intact now that a judge has rejected Abbott's motion arguing that the plaintiffs' claims should be thrown out because the drugmaker's actions didn't amount to exclusionary conduct.

Abbott Laboratories has asked a judge to throw out four recently amended complaints filed by pharmacies, wholesale direct drug purchasers and rival drug manufacturers alleging Abbott illegally jacked up the prices of its market-dominating HIV drugs, calling the complaints “a vain attempt to plead around” recent antitrust case law.

Rite Aid Corp., CVS Pharmacy Inc. and several other pharmacy chains have filed a second amended complaint in their antitrust action against Abbott Laboratories alleging the drugmaker illegally jacked up the prices of its market-dominating HIV medications, following an appeals court ruling that a similar class action against Abbott failed to state a valid claim in light of recent case law.
