A judge has declined to toss a $5 million suit that claims Boston Red Sox slugger David Ortiz’s Forty Forty club in the Dominican Republic and its U.S. website are a rip-off of The 40/40 Club, a New York nightspot partially owned by rapper Jay-Z.

Rapper Jay-Z and his business partner have sued Boston Red Sox hitter David Ortiz for trademark infringement, claiming the baseball player opened a nightclub in his home country of the Dominican Republic called Forty Forty after visiting Jay Z’s well-known Manhattan nightspot The 40/40 Club.
