Vitamin Shoppe Industries Inc. on Tuesday settled the remainder of a class action that accused the retail chain of calling its clerks "managers" to dodge overtime pay, after beating most of the suit at the class certification stage.

A New York federal judge on Monday refused to certify proposed nationwide or statewide classes of Vitamin Shoppe Industries Inc. store managers who claim the chain failed to pay proper overtime, but allowed claims to proceed in relation to seven individual stores.
