Prosecutors on Monday told a New York federal judge that a former Westgate Capital Management LLC investment manager serving 40 years for a $140 million fraud cannot blame his lawyer for bad advice in a bid to vacate his prison sentence.

An ex-hedge fund manager who pled guilty to defrauding investors of millions asked a New York federal judge Tuesday to vacate his 40-year prison sentence, saying he was the victim of an ineffective lawyer who advised him to accept an unjust deal.
