An Indiana federal judge handed National Union Fire Insurance Company of Pittsburgh, Pa., a win Thursday in its suit against Mead Johnson & Co. seeking to avoid covering false advertising damages in a consolidated underlying suit over the company's baby formula Enfamil.

Mead Johnson & Co. on Friday lost a bid to lodge counterclaims against National Union Fire Insurance Co. of Pittsburgh, PA in one of two lawsuits the insurer filed to avoid liability for false advertising damages stemming from suits brought by a rival and class of consumers over the nutrition company's Enfamil baby formula.

National Union Fire Insurance Co. of Pittsburgh, Pa., dropped PBM Products LLC from a coverage suit in Indiana on Wednesday after PBM said the insurer owed it nothing for an underlying false advertising case against insuree Mead Johnson & Co LLC.
