A Washington federal judge on Friday ruled that a proposed racial discrimination class action brought by former agents of the U.S. Marshals Service must proceed even though the lead plaintiff in the case has settled his claims, rejecting arguments from USMS that the remaining plaintiffs have not exhausted their administrative remedies.

A Washington federal judge on Thursday rejected a bid by the U.S. Marshals Service to use the U.S. Supreme Court's Wal-Mart v. Dukes decision to dismiss former marshals' proposed class action alleging race discrimination, saying the landmark ruling didn't apply at the pleading stage.
