General Mills Inc. on Monday escaped a putative class action alleging it tricked customers into believing Total Blueberry Pomegranate contained actual fruit, after the plaintiff dropped his claims over fears that the suit wouldn't survive a pending dismissal motion.

A California federal judge on Monday threw out a putative class complaint against General Mills Inc. that alleged the company tricked customers into believing Total Blueberry Pomegranate contained the titular fruits, but gave the plaintiff leave to amend his filing.
