A Kentucky federal judge on Tuesday tossed a Hardy Oil Co. Inc. suit alleging Wells Fargo Insurance-Indiana failed to recommend policies that would have protected it from liability in a massive fuel leak, saying the company would not have qualified for such coverage.

A federal judge in Kentucky said Friday that a pollution exclusion in Hardy Oil Co. Inc.'s commercial general liability policy would block coverage for an extensive fuel contamination cleanup, but gave defendant Wells Fargo Insurance-Indiana a chance to fight that determination.
