The Tennessee Valley Authority and property owners affected by a 2008 coal ash spill agreed Monday to forgo a second evidentiary trial in consolidated litigation over the disaster, consenting to make their arguments based on evidence introduced in a recently completed trial.

The Tennessee Valley Authority on Tuesday had claims for personal injury, emotional distress and inverse condemnation trimmed from consolidated litigation in federal court over the 2008 spill of coal ash sludge near the Watts Bar Reservoir.
