An Illinois-based dairy distributor on Monday agreed to drop a suit accusing Dean Foods Co. of breaching of a distribution contract and violating antitrust law, though the dismissal won't be final until the distributor has satisfied its outstanding debts to a Dean subsidiary.

A Wisconsin federal judge on Monday tossed most of a suit brought by an Illinois-based dairy distributor against milk products giant Dean Foods Co., finding little basis for the distributor's antitrust claims.

Fresh N' Pure Distributors Inc. hit Dean Foods Co. and a Wisconsin milk processor with an antitrust suit Tuesday, saying the companies breached a distribution contract when Dean bought the processor and are strangling competition in the northeastern Illinois milk market.
