A California federal judge on Tuesday threw out claims for reinstatement and full back pay in a False Claims Act suit over alleged kickbacks against drugmaker Gilead Sciences Inc., ruling that a former employee would have been fired for erasing documents from a company-issued laptop.

Gilead Sciences Inc. on Monday asked a California federal judge to toss a whistleblower's False Claims Act suit for retaliatory firing, saying dismissal of the claim is the proper sanction for the plaintiff's alleged destruction of documents amid a suit claiming Gilead paid kickbacks to doctors.
