A former health care products company chairman who pled guilty to passing along inside information cannot vacate a related civil settlement with the U.S. Securities and Exchange Commission in light of the Second Circuit's ruling in U.S. v. Newman, a New Jersey federal judge has found.

A New Jersey federal judge granted the U.S. Securities and Exchange Commission's request Monday to reopen its lawsuit against the former head of medical device maker Home Diagnostics Inc., who pled guilty to insider trading ahead of a merger in a corresponding criminal case last year.
