A New Jersey federal judge has held that a licensing and supply agreement a small pharmaceutical company inked with an entity for the anti-nausea drug Aloxi did not trigger the “on-sale bar” under the America Invents Act.

A New Jersey federal judge on Monday ruled that Teva Pharmaceuticals USA Inc. is infringing four patents covering Helsinn Healthcare SA's anti-nausea drug Aloxi and blocked Teva from releasing its planned generic version of the drug until 2024.
