Two former Capital One Financial Corp. officers agreed Tuesday to pay $20 million to settle the bank's suit accusing them of breaching a noncompete agreement when they planned to move into the New York City market with their new employer, BankUnited Inc.

Two former Capital One Financial Corp. officers told a Virginia federal court Friday that a noncompete pact barring them from accepting executive posts at any rival New York banks is overbroad and unenforceable, and urged the court to throw out the bank's suit against them.
