Ruby Tuesday Inc. has agreed to pay $575,000 to settle an age bias lawsuit in which the U.S. Equal Employment Opportunity Commission accused several of the chain's restaurants of discriminating against applicants over 40, according to court documents filed Monday in Pennsylvania federal court.

A Pennsylvania federal judge on Tuesday refused to dismiss an age bias suit against restaurant chain Ruby Tuesday Inc. but ordered the U.S. Equal Employment Opportunity Commission to more sufficiently back up its claims and participate in conciliation discussions within the next 45 days.

Ruby Tuesday Inc. asked a Pennsylvania federal judge Thursday to dismiss the U.S. Equal Employment Opportunity Commission's claims that the restaurant wouldn't hire older applicants, calling the agency's lawsuit "spare and conclusory."
