A California federal judge on Thursday refused to revive Giganews Inc.'s bid for sanctions against adult website operator Perfect 10 Inc., which unsuccessfully sued Giganews for copyright infringement, saying that the sanctions request is moot because the court has already awarded Giganews about $5.6 million in attorneys' fees and costs.

Perfect 10 Inc. is fighting off a sanctions bid from Giganews Inc., a company it unsuccessfully sued for copyright infringement, less than a month after a California federal judge ordered the adult website operator to pay $5.6 million in attorneys' fees and costs, saying Monday the bid was "overreaching and legally flawed."

A California federal judge on Tuesday ordered adult website operator Perfect 10 Inc. to pay $5.2 million in attorney fees and $424,000 in costs following its failed copyright infringement suit against Giganews Inc., ruling that the award of fees would serve the purposes of the Copyright Act.
