A federal court decision last week lambasting Medicare for its disproportionate share hospital payment calculations and invalidating an agency rule could mean hundreds of millions more dollars for hospitals for past payments, and may also lead to new rulemaking that could bring increased payments for years to come.

In another win for hospitals in the disproportionate share payment saga Thursday, the Washington federal court struck down a Medicare rule that changed how payments are calculated, saying the U.S. Department of Health and Human Services tried to use the complexity of Medicare to hide its bad rulemaking.
