Glam-rock band Poison and EMI subsidiary Capitol Records Inc. moved Tuesday to dismiss a copyright suit brought by two musicians, saying it came too late since 25 years had passed since the band allegedly ripped off four songs.

Hair metal mainstays Poison, as well as EMI Music Marketing and EMI subsidiary Capitol Records Inc., were hit with a copyright suit Wednesday by a musician claiming four of the band's hits directly copied works he co-wrote with Poison lead guitarist C.C. DeVille.
