A Waste Management Inc. subsidiary on Monday asked a Texas federal judge to reinstate its coverage dispute with Travelers Indemnity Co. over pollution of a Texas river, saying the companies were unable to reach an agreement about final settlement documentation.

Waste Management said Friday it has reached a settlement with Travelers in a battle over coverage for a U.S. Environmental Protection Agency proceeding regarding a predecessor's alleged pollution of a Texas river, a year after the Texas Supreme Court ruled the EPA action constituted a suit triggering the insurer's duty to defend.

The Texas Supreme Court ruled Friday that a U.S. Environmental Protection Agency proceeding against an alleged polluter is a "suit" and should be defended by insurers, in a 5-4 decision the dissenting judges called a "disturbing" deviation from state insurance law.

A federal judge ruled Thursday that The Travelers Indemnity Co. does not have to cover the more than $2 million a Waste Management Inc. predecessor spent quarreling with the U.S. Environmental Protection Agency over its alleged pollution of a Texas river, saying the agency's enforcement actions do not constitute litigation that would trigger coverage.
