DaVita Inc. unit Total Renal Care Inc. on Tuesday urged a Texas federal judge to wipe out a whistleblower's False Claims Act retaliation lawsuit, saying that it fired the nurse because of his attitude problem and that there are no allegations it defrauded taxpayers.

DaVita Inc. subsidiary Total Renal Care Inc. must face allegations it violated the federal False Claims Act when it fired a registered nurse after he warned supervisors of plans to blow the whistle on a coworker's suspected Medicare fraud, a Texas federal judge ruled Monday.
