Allergan Inc. and two Japanese pharmaceutical companies on Monday failed in their renewed efforts to target Apotex Inc. for infringement of a patent used in Allergan's pinkeye treatment Zymar after a Delaware federal judge said a re-examination of the patent couldn't breathe life into the previously resolved dispute.

Allergan Inc. and two Japanese pharmaceutical companies sued generics maker Apotex Inc. again in Delaware on Monday, alleging it has infringed a recently re-examined patent in seeking approval for a generic version of pinkeye treatment Zymar.
