A magistrate judge on Monday recommended Stryker Corp. not be allowed to make new consequential damages and bad faith settlement claims against XL Insurance America Inc. in its suit seeking coverage for litigation over its allegedly defective artificial knee, saying the claims aren't part of the case and never were.
