Trinity Industries Inc. told a Texas federal judge Wednesday that attorney ethics rules prohibit the company's former law firm McKool Smith PC from representing a plaintiff in False Claims Act litigation that accuses Trinity of secretly modifying the design of its ET-Plus guardrail end terminal.

A Texas federal judge Monday declined to toss a False Claims Act suit alleging that Trinity Industries Inc. secretly changed the design of its ET-Plus guardrail end terminal, finding the plaintiff entitled to additional discovery to prove his accusations.
