Mylan Inc. has settled its dispute with Teva Pharmaceuticals USA Inc. concerning its suit against the U.S. Food and Drug Administration over allegations that Teva and subsidiary Cephalon Inc. worked to stymie generic competition of the sleep disorder drug Provigil, Mylan said Friday.

A judge on Monday rejected Mylan Pharmaceuticals Inc.'s argument that Teva Pharmaceuticals USA Inc. and its affiliate Cephalon Inc. had worked together to stymie generic competition of sleep disorder drug Provigil and shot down Mylan's bid to block additional market exclusivity granted to Teva by federal regulators.

Mylan Inc. asked a federal judge Wednesday to block the U.S. Food and Drug Administration's decision giving Teva Pharmaceuticals USA Inc. 180-day exclusivity to market a generic version of Provigil, arguing Teva and its affiliate Cephalon Inc. had worked together to stymie generic competition of the Cephalon sleep disorder drug.
