The Fourth Circuit on Friday ruled A&G Coal Corp. must be held liable for Clean Water Act violations stemming from selenium discharges at a mountaintop removal mine, finding that the company can't use its operating permit as a shield from liability.

Coal Mine's Selenium Discharge Violates CWA, Judge Says
Virginia-based mining firm A&G Coal Corp. is liable for Clean Water Act violations stemming from a selenium discharge from one of its surface mines in the state, even though it has permits to run its operations, a Virginia federal judge ruled Monday.
