A panel of First Circuit judges has tossed a statistician's suit accusing two Massachusetts hospitals of submitting false claims to the National Institutes of Health for more than $12 million in Alzheimer's disease research grants, saying the case has had its day in court before a jury.

Two Massachusetts hospitals on Friday asked a federal judge to toss a consultant's suit accusing them of submitting false claims to the National Institutes of Health to win more than $12 million in grants for Alzheimer's disease research, arguing there wasn't enough evidence to back the allegations.
